Six months a year in the country, and your hands on the business. The principal applicant must physically reside in the United States for at least 6 months a year to maintain the visa, and must actively manage the enterprise's day-to-day activities or its policy formulation. Read alongside "live, study, or work anywhere in the USA", that can sound optional. It is a condition of holding the visa, and it is what separates EB-5 from the golden visas — several of which ask for no presence at all.
The first Green Card is conditional. Approval of the I-526E petition leads to a two-year conditional card. Permanent residence comes only after those two years, once an I-829 petition has been filed and the conditions removed. Plan on the full arc rather than the first approval.

The qualifying investment is at risk by design — EB-5 requires it, and a guaranteed return would disqualify the application. Where the investment is made through a Regional Center, the partnership agreement governs what happens on a petition denial, and reading it is the part of this process that most repays care. Health insurance is published without a per-person marker where biometrics carries one, so it is charged once — worth confirming.
