But the sponsor has to be approved, the occupation has to be on the list, and in most cases the employer has to prove they tried to hire locally first. None of that is yours to do.

This Visa Is Tied to One Employer

The sponsorship is the visa. You are admitted to work full-time for your sponsoring employer, on the specific position they nominated, in an occupation on the Skills in Demand List. That is a materially different proposition from the National Innovation Visa, which grants permanent residence with no employer attached at all.

Before you commit to this route, settle two things with the company in writing: that they are — or will become — an approved Standard Business Sponsor, and who bears each of the government charges in the term sheet below. The source attributes three of the four to the employer.

Two Gates Outside Your Control

Labour market testing. In most cases the employer must show evidence that they advertised the role and could not fill it locally. A willing employer who has not done this cannot nominate you yet, and the timing is theirs.

Sponsorship approval, and its five-year clock. Becoming an approved Standard Business Sponsor is a separate application with its own AUD 420 fee, and the approval then runs five years. An employer who has sponsored someone recently is already through it — which is why the term sheet lets you switch that fee off.

The employer nominates the specific position you would fill. The nominated occupation must sit on the relevant Skilled Occupation List; in most cases the employer must provide evidence of labour market testing — that they tried and failed to fill the role locally; the position must meet the market salary rate and Australian employment conditions; and the employer pays the Skilling Australians Fund levy.
